    • This course covers the basics of electronically stored information. The electronic discovery model will be explained. Attendees will leave with an understanding of the guiding legal principles.

Topics will include data mapping, employee equipment tracking and cloud based data storage and SAAS considerations. The importance of data management policies, like Bring Your Own Device (BYOD) policies, and document retention policies will be discussed.     • This course outlines the data collection assessment process and planning considerations. Collection alternatives will be outlined. The difference between active file and full forensic file collections will also be explained.
  • Collection, Processing, Review & Production
    • This course identified key consideration points after the preservation phase and once litigation or investigation has commenced. Specific topics include preparing for the meet and confer conference and the importance of summarizing agreements with opposing counsel via eStipulations and similar documentation. Data collection, data culling/ECA and data processing alternatives will be addressed including general guidance on the appropriateness of alternatives based on specific matter scenarios, the up-front pricing of each option and the potential impact to the total project costs. An overview of the efficiencies of document review accelerators including near duplication identification, email threading and predictive coding will be provided. Finally, production format and general turnaround times will be reviewed. The guidance throughout the course will be tailored to address small, medium and large cases.

    • This course explains Technology Assisted Review in discovery and the various opportunities for its use.
  • Document Review Workflow & Strategies
    • This course begins with an overview of the fundamentals of document review. Production considerations will be discussed as well as preservation alternatives. Finally, review workflow considerations for small, medium and large cases will be covered.
  • Taming the Beast: Practical Tips for Controlling Costs and Reducing Risks in eDiscovery
    • eDiscovery can be messy, expensive and fraught with risk…but it doesn’t have to be. This course will outline practical tips to streamline the process to reduce the legal risks and keep costs under control. You will leave with an outline of considerations to serve as your guide for eDiscovery success in future matters and some sample legal templates that you can incorporate into your practice. We will discuss the strategy differences between large and small cases, negotiation tactics with opposing counsel, and how to avoid the common “gotchas” that can drive costs up and slow down case momentum. By the end of the course, you will be able to identify simple adjustments that you can incorporate into your practice to discover smarter.
